Statement on "Revocation" Hearing
Statement from Richard Gammonley on the latest developments involving the Hinsdale Village Board and its so-called "revocation hearing" held on Saturday, Feb. 18, 2006:
On Friday, a day before this so-called 'revocation hearing,' we sent a letter to the village warning them that by scheduling meetings for the purpose of repealing the ordinance and/or rescinding the agreement for Garfield I, it has anticipatorily breached and repudiated the agreement.
As we stated in the letter, if the village takes action to repeal the Garfield I ordinance and/or to rescind the agreement, then Anno Domini IV will pursue all lawful remedies available to us. This includes seeking an award of financial damages, which we estimate will exceed $10 million if the Garfield development is prevented by the village's unlawful acts.
As of this date, it is our understanding that the village has not made a decision on this matter. They would do well to drop this ludicrous line of action, which has already resulted in our pursuing a breach of contract claim.
It is beyond comprehension--and against legal prudence--that the village board is now trying to go back and erase time and change the approval that they have given in the past.
This course of events has left us with no choice but to take a pre-emptive measure warning Hinsdale officials of the consequences of their irresponsible actions. We seek a speedy, and just, resolution that will result in construction of The Garfield without further burden to Hinsdale's taxpayers.
Lastly, throughout this saga, Anno Domini IV has asked village officials to articulate their desire for the future use of the Garfield site. In all of that time, the village has never indicated what they do want to see take shape. We invite Hinsdale's government leaders to make a clear, public declaration of their desires for that location.
As always, we are more than willing to be responsive to civil, reasonable dialogue on development, construction, design and related issues.
